Terms of Service

1. About AskAnyone

AskAnyone ("the Service") is operated by The OpenMined Foundation, a 501(c)(3) non-profit foundation ("OpenMined", "we", "us", "our"). The Service provides AI-powered automated direct message responses for Instagram professional accounts and Facebook Pages. By connecting your account to the Service, you agree to these Terms.

2. Eligibility

You must have an Instagram professional account (Business or Creator) and/or a Facebook Page, and the authority to grant third-party access to those accounts. You must be at least 18 years old.

3. What the Service Does

• Receives direct messages sent to your connected Instagram account and/or Facebook Page via Meta's API
• Classifies incoming messages (e.g., knowledge-base questions, spam, business inquiries, fan mail)
• Generates AI-powered replies based on your provided content
• Sends automated replies on your behalf through Meta's API
• Provides an admin dashboard for analytics, message review, and manual intervention

4. Your Responsibilities

• You are responsible for the content you provide to inform the Service's responses
• You must ensure that automated replies comply with Meta's Community Guidelines and Terms of Use
• You must not use the Service to send spam, misleading information, or content that violates applicable laws
• You are responsible for monitoring the admin dashboard and handling messages that require manual review

5. Data and Privacy

Our handling of data is described in our Privacy Policy. By using the Service, you consent to the data practices described therein.

6. Meta Permissions

The Service requests only the permissions necessary for its core functionality:

• instagram_business_manage_messages — read incoming Instagram DMs and send replies on your behalf
• instagram_business_basic — identify the Instagram account being connected during onboarding
• pages_messaging — read incoming Facebook Messenger DMs and send replies on behalf of your Facebook Page
• pages_show_list — list the Facebook Pages you manage during the onboarding flow so you can select which Page to connect

You can revoke these permissions at any time through your Instagram or Facebook account settings, or via Meta Business Suite.

7. AI-Generated Content

Replies are generated by AI based on your provided content. While the Service strives for accuracy, AI-generated responses may occasionally contain errors. You acknowledge that:

• The Service does not guarantee the accuracy of automated replies
• You should review AI-generated responses through the admin dashboard
• OpenMined is not liable for any consequences arising from AI-generated replies sent on your behalf

8. Intellectual Property

You retain all rights in the content you provide to the Service (such as articles, videos, and other material used to inform AI-generated responses). By providing content, you grant OpenMined a limited, non-exclusive, royalty-free licence to store and process that content solely for the purpose of delivering the Service to you. This licence ends when you disconnect your account and your content is deleted.

AI-generated replies sent on your behalf through the Service are your responsibility. OpenMined does not claim ownership over those replies.

The source code that powers the Service is open source and licensed under the Apache License, Version 2.0, and is available in OpenMined's public GitHub repositories. Your rights to use, modify, and redistribute that code are governed by the Apache 2.0 license. OpenMined retains all rights in the hosted Service itself, including its trademarks, branding, deployed infrastructure, configurations, and any proprietary components not released under an open source license.

9. Children's Privacy

The Service is not intended for use by anyone under the age of 18. We do not knowingly collect data from minors. If you believe a minor has submitted personal information through the Service, please contact us immediately.

10. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. The Service depends on third-party APIs that may experience downtime. We will make reasonable efforts to notify you of planned maintenance.

11. Termination

Either party may terminate this agreement at any time. You can disconnect your account and stop using the Service. We may suspend or terminate your access if you violate these Terms. Upon disconnection, your access tokens are deleted immediately. Fan message history is retained for up to 30 days to allow final review, then permanently deleted in accordance with our Privacy Policy.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of AI-generated responses, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, OpenMined shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost followers, missed business opportunities, or reputational harm from AI-generated replies.

14. Indemnification

You agree to indemnify, defend, and hold harmless The OpenMined Foundation and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) the content you provide to inform AI-generated responses; (c) automated replies sent on your behalf through the Service; or (d) your violation of these Terms or any applicable law or third-party rights, including Meta's Platform Terms.

15. Changes to These Terms

We may update these Terms from time to time. We will notify connected users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
